Terms and Conditions

General terms and conditions*

* No rights can be derived from the English translation. This version has been translated from
the Dutch version only as a service. The Dutch general terms and conditions apply.

By accepting the general terms and conditions, you explicitly declare that you have taken note of the general terms and conditions, house rules and payment agreements of GymBokx and that you will adhere to them. The membership will only end if the agreed contract period is terminated as described in our general terms and conditions. The membership will therefore not end automatically, regardless of whether or not you train!

Article 1: Membership
1. Commencement:
1.1 Each membership starts on the day of registration. The chosen contract period starts on the 1st of the month. If you become a member during the current month, a broken monthly amount will be charged pro rata, after which the first term of the membership (month or year) will start on the first of the following month.
1.2 Each membership is required to be purchased for a minimum duration of one full calendar month (plus any pro-rata period)

Standard Year per month: 12 months (+ pro-rata period) at 39.95 per month
Standard Month: 1 month (+ pro-rata period) at 50.95 per month
Standard Scholier en Student Year per month: 12 months (+ pro-rata period) at 32 per month
Standard 65+: Year per month (12 months + pro-rata period) at 32 per month

Premium
Premium year per month: 12 months (+ pro-rata period) at 51.95 per month
Premium Month: 1 month (+ pro-rato period) at 61.95 per month
Premium School/Student Year per month: 12 months (+ pro-rato period) at 39.50 per month
65+ Premium Year per month: 12 months (+ pro-rato period) at 39.50 per month

Personal Training
Single lesson: 1 hour: 67.50 (valid for 1 week)
Personal training 1x per week: 12 weeks: 259,- per 4 weeks
Personal training 2x per week: 12 weeks: 449,- per 4 weeks
Personal training 3x per week: 12 weeks: 639,- per 4 weeks

2. All memberships and associated payment obligation will continue at all times for the entire closed period, whereby the end date will be postponed proportionally to the duration of any pauses.

3. Access
You can enter once a day with the tag. If you want to train more often per day, this can be arranged in advance with customer service.

Article 2: Cooling-off period and withdrawal
1. If you have concluded your membership online (outside the GymBokx location), you are entitled to a statutory cooling-off period of 14 days after registration.
2. By registering, you expressly agree to the immediate start of the membership. The right of withdrawal expires once, within these 14 days, you first make use of the facilities or services of GymBokx, or take access to GymBokx by checking in or entering the training area.
3. As long as you have not made use of the facilities or services of GymBokx and have not taken access to GymBokx, you may withdraw from the agreement free of charge within 14 days after registration.
4. The right of withdrawal does not apply if the membership is concluded (digitally) at the GymBokx location.

Article 3: Extending/upgrading membership
1. All memberships are automatically tacitly extended per indicated period after the first full agreed period.
Basic:
Basic Year per month: 29.95 per month (after 12 months)
Basic Month: 40.95 per month (after 1 month)
Basic Scholier/Student year per month: 29.95 per month (after 12 months)
Basic 65+ years per month: 24 per month (after 12 months)

Standard:
Standard Year per month: 39.95 per month (after 12 months)
Standard Month: 40.95 per month (after 1 month)
Standard Scholier/Student year per month: 39.95 per month (after 12 months)
Standard 65+ years per month: 32 per month (after 12 months)

Premium:
Premium Year per month: 51.95 per month (after 12 months)
Premium Month: 61.95 per month (after 1 month)
Premium Scholier/Student year per month: 51.95 per month (after 12 months)
Premium 65+ years per month: 39.50 per month (after 12 months)

Personal Training:
Personal training 1x per week: 259 per 4 weeks (after 12 weeks)
Personal training 2x per week: 449 per 4 weeks (after 12 weeks)
Personal training 3x per week: 639 per 4 weeks (after 12 weeks)

*Scholier/Student memberships are extended monthly after 1 year (12 months) with the price of a regular year per month membership (Basic 29.95, Standard 39,95 and Premium 51.95 respectively). If you are still a student at that time, you must complete a renewal form in order to be able to use the discount price again.

2. If you renew with a new membership via the renewal form, you will enter into a new membership with the associated chosen membership period and payment obligations. This will cancel any monthly cancellation of your old membership. 3. When renewing by submitting a renewal form, your new membership will start on the first of the following calendar month.

Article 4: Upgrading membership.
1. It is possible to upgrade your Basic membership to a Standard, Premium or Personal Training and Standard to Premium or Personal Trainings, within the chosen contract period. You then enter into a new term of 1 year or 12 weeks for personal training (see article 4.5). It is not possible to downgrade your membership from a Premium membership to a Standard or Basic, or Standard to Basic membership in the meantime.
2. To upgrade your membership, you must complete the renewal form that can be found in the link, in the GymBokx app or via the FAQ on the website. If it is not converted in writing in time, the membership will be automatically extended without notice (see article 3.1). During this period, the obligation to pay the due contributions to GymBokx remains, even if the facilities are possibly not used.
3. Upgrading is possible on the first of the following calendar month.
4. It is not possible to downgrade your membership at once. It is possible to downgrade at the end of the entire contract period.
5. When upgrading to Personal Training, your current membership will be paused during the period of personal training at GymBokx. The initial term of the paused membership remains the same and the end date will therefore be moved proportionally to the duration of the personal training at GymBokx.
6. You can only upgrade with a membership period that is longer than the remaining membership period of your old membership.

Article 5: Cancellation of membership
1. You can cancel via the cancellation form that you can find in the FAQ on the website gymbokx.nl. After correctly completing and sending the form, you will always receive a confirmation email immediately. Without this confirmation, your cancellation is not valid. If you have not received confirmation, it is up to you to contact GymBokx customer service via WhatsApp or email. Until then, you remain liable for payment.
2. Your cancellation must be submitted correctly in writing via the cancellation form at least 14 days before the end of the current contract (including receipt of the confirmation email). If you do this on or within 14 days of the end of your contract, your membership will continue for 1 full calendar month and the obligation to pay the due contributions to GymBokx remains, even if the facilities are not used.
3. Interim cancellation is not possible. The full number of months incl. pro-rato period must be paid at all times.
4. Moving leniency: if you move more than 10 km away from GymBokx, you can claim the moving leniency. In this case, you must submit proof of registration at the new location to GymBokx. Your current membership will be converted retroactively to a monthly cancellable membership. The difference in price of the previous period will be invoiced to you. After payment of this, your membership will be terminated as of the new end date. This end date cannot be in the past and will be communicated to you by customer service after submitting the required proof. If the invoice has not been paid before the new end date, the leniency arrangement will expire and you must submit a new application and a new invoice will follow based on the new, changed, end date.

Article 6: Pausing membership
1. Memberships can be paused a maximum of once per contract year, with a maximum of 3 consecutive months, upon presentation of a medical certificate. You can request this pause via the website https://gymbokx.nl/pauzeren/ where you can also submit your scanned medical certificate.
2. In case of pregnancy, you can pause for a maximum of 9 consecutive months.
3. Pausing a membership retroactively or retroactively is not permitted. The request for the pause must be made before the pause period. Granted pauses take effect immediately or on the requested date in the future.

Article 7: Membership is strictly personal
1. The membership only applies to the stated activities and the stated duration and price. Unless expressly stated otherwise, the membership is strictly personal, non-transferable and can only be used by and for the purchaser of the membership and the tag or club card.
2. In addition to article 7.1, passing on a club card, and thus a membership, to another person is strictly prohibited. If you violate this rule, you are guilty of committing fraud. See article 18.
3. In addition to article 7.1, reselling a membership to another person is prohibited. By violating this rule, you are guilty of committing fraud. See article 18.
4. Going through the GymBokx gate together with 1 tag or club pass is strictly prohibited. By violating this rule, you are guilty of committing fraud. See article 18.
5. Entering GymBokx illegally or allowing someone to enter GymBokx is considered burglary or assisting in burglary, which will be reported to the authorities.

Article 8: Agreements
1. Appointments made with GymBokx must be cancelled at least 24 hours before the start. If not kept or cancelled in time, the credit for this appointment will expire.
2. If a new appointment is desired, the customer must purchase a new credit.
3. Personal Training appointments that have been cancelled in time, as stated in article 8.1, can only be made up within the term contractually agreed.

Article 9: Opening hours & rates
1. GymBokx is entitled to change the opening hours, class schedules and rates at all times. During official holidays, for example, GymBokx reserves the right to close the club, without this leading to a reduction in the contribution or any refund thereof.
2. Rate changes will be implemented for new and current memberships.
3. Once a year, from 1 January, we may increase our rates by a maximum of 5% (plus the CBS price index figure for family consumption) per year from the last rate increase. If we make use of this, this does not entitle us to terminate the agreement, unless the rate increase occurs within three months after the conclusion of the agreement or is higher than 5% (plus the CBS price index figure for household consumption) per year from the last rate increase. Rate adjustments due to government measures such as VAT increase, without excluding other government measures, can be implemented immediately regardless of the amount and do not entitle us to termination.
4. The goodwill arrangement in the event of an increase within 3 months is to divide the new amount per month by the remaining outstanding amount of the initial membership, which leaves a shorter membership period and you do not pay more than the total amount of your entire membership that was initially agreed.
5. If no written objection is made within 4 weeks after the announcement of the increase, you agree to the price increase and the right to goodwill or interim termination lapses.

Article 10: Payment
1. By agreeing to our general terms and conditions, you give permission to the GymBokx branch where you register to continuously debit direct debit orders from your account in accordance with the order from GymBokx. If you do not agree with this debit, you can have it reversed. To do this, contact your bank immediately within eight weeks of the debit. Ask your bank for the conditions. Please note: in the event of an unjustified reversal, we charge extra costs per reversal. Reversal of direct debit €5 and reversal of the direct debit on a credit card €10. We therefore always advise you to contact our customer service first before you reverse.
2. GymBokx collects the amount due 1-7 days before the start of the new period.
3. The first payment for your membership is made, for the one-off costs and pro-rata term of your membership, immediately upon registration or at the latest before your first visit by means of payment via iDEAL, Credit Card or direct debit.
4. All memberships will be paid after the first term (article 10.1) in the manner chosen by you, by direct debit. For this reason, you are obliged to provide your IBAN for the monthly direct debit after this first term and therefore you are obliged to ensure that there is sufficient balance on your bank account from which GymBokx is authorised to collect.
5. The due contributions will be automatically collected per month, per 4 weeks (only for personal training) or per year (in one go or per month).

Article 11: Satisfaction guarantee
1. Satisfaction guarantee only applies when the following conditions are met:
– Only applicable to Basic Year pay per month and Premium Year pay per month
– minimum 24 training sessions of at least 30 minutes in 3 calendar months by the member who wants to claim the guarantee.
– When the guarantee is used, the monthly discount per month that you receive with a year membership with monthly payment expires. As a result, you are liable to pay for 3(months) x (difference between “month” and “year per month”) + the difference in price of the prorata period.
– The payment for this must be paid no later than 00:00 on the last day of the 3 months via the payment link sent by us after receipt of the submitted “satisfaction guarantee form”.
– In the case of a prorata period, the number of training sessions is increased in proportion to the number of days in the prorata period by x number of training sessions per prorata day rounded down to a whole number.
– No collection/payment of membership fees may have been missed.
– The “satisfaction guarantee form” must be submitted in full and no later than 3 working days before the end of the 3rd calendar month. You will receive a confirmation of receipt immediately upon completion. Keep this safe, this is your proof should you unexpectedly need proof. If you do not receive it immediately (first check your spam/junk mail on both your telephone and via a PC or laptop), please contact Lisa from our customer service within 24 hours by email or WhatsApp. Again, without the confirmation of receipt your application is NOT valid/received.

Article 12: Reminder procedure, costs and collection agency
1. Procedure and costs:
If a payment is not made, a first free reminder will be sent by email immediately (except in the case of a reversal, in which case the costs from article 10 will be charged) which you must pay within 7 days.
If this is not paid, a 2nd automatic collection will follow, with 2.50 in reminder costs and the access pass (tag) will be blocked until the invoice has been paid.
If this is not paid either, you will receive a 3rd reminder, which must be paid within 5 days, whereby the reminder costs will be increased to 5,-.
If this is not paid either, you will receive a final reminder and notification, which must be paid within 2 days, whereby the reminder costs will be increased to 10,-.
If this last reminder is not paid either, your full membership for the remaining months until the end of your contract (including all additional costs) will become immediately due and payable by the collection agency.
2. The outstanding (total) invoice will be claimed once by the collection agency without collection costs (but with the aforementioned reminder and/or reversal costs). This can be paid to the collection agency in one go or by means of a payment arrangement (of at least the monthly costs of the membership). All judicial and extrajudicial (collection) costs that GymBokx must make as a result of the non-compliance will be entirely at your expense. The compensation for extrajudicial costs is fixed at 15% of the principal amount due (with a minimum of € 40.00 per claim). In addition, statutory interest will be charged on the principal amount from the date of due.
3. From this moment on, all forms of communication about the payments will go through the collection agency. Our customer service or financial administration can no longer make any agreements with you after this.
Access to GymBokx will be denied by means of a block on the tag or club card if the above applies. Only after payment of the entire invoice or the first payment of the payment arrangement with the collection agency has been made will the block be lifted and you will again have access to exercising at GymBokx.

Article 13: Clothing regulations & towel use
1. In the sports areas, correct sports clothing must be worn at all times. In addition, it is mandatory to wear clean sports shoes and use a towel.

Article 14: Order/instruction regulations
1. It is not permitted to use and/or trade drugs or stimulants in general. Use/trading of such substances will lead to immediate termination of membership upon detection, without any right to reimbursement of paid contributions.
2. Members must adhere to the instructions and regulations given by GymBokx (or its employees) with regard to, among other things, clothing, necessary order and discipline (appropriate clothing in the opinion of GymBokx, and also the expression of noisy behaviour and/or inappropriate language, such in the opinion of GymBokx, or its employees). In the event of violation, GymBokx is entitled to deny members access to the club and to terminate membership immediately, without any right to reimbursement of paid contributions.

Article 15: Safety and liability
1. The use of the facilities within GymBokx is at your own risk. GymBokx is not liable for damage resulting from accidents, theft, fire or any other damage-causing events, unless GymBokx can be blamed for intent or gross negligence.
2. The deliberate or unconscious damage to material that is the property of GymBokx will be recovered in full from the customer in question. From that moment on, the customer is responsible for compensating GymBokx, by paying a replacement price for the damaged object or by intermediary of his or her insurance company.

Article 16: Compliance with the agreement
1. By signing (by sending a GymBokx registration form, IDEAL deposit or authorization for direct debit) the membership agreement, each member declares to comply with the general terms and conditions drawn up by GymBokx and the house rules set in the club. GymBokx is at all times entitled to deny access to anyone who does not comply with the terms/rules for a period to be determined by GymBokx, without any right to reimbursement of contributions already paid.

Article 17: Use of lockers
1. GymBokx has made a selected number of lockers available to all GymBokx members. These lockers may be used free of charge. Each member must bring their own padlock to lock the locker. Padlocks may have a thickness of 4-6mm.
2. Each member must take the lock with them immediately after exercising, when leaving the GymBokx building, and leave the locker empty. GymBokx staff will check this at the end of each day. Any items left behind will be placed with the lost and found. Padlocks from locked lockers will be removed and destroyed without any form of reimbursement.

Article 18: Fraud
1. All matters concerning fraud will be fined as stated in article 18.2. Among other things: matters such as improper use of cards, transferring memberships, filling in and/or changing incorrect personal data and other fraudulent matters.
2. In the event of a violation of the provisions of 18.1, GymBokx will forfeit to the customer an immediately and immediately payable fine of €604.35 without notice of default or notice of default ("Premium Year in One Go" membership incl. one-off costs) for each violation, without GymBokx being obliged to prove damages and without prejudice to GymBokx's right to a to claim damages on top of the fine for the fraud and to collect them by direct debit from the account number of the fraudulent member.
When a tag or club card is stolen and/or used by third parties, the burden of proof, including reporting to the police, will lie with the customer who owns the tag or club card.

Article 19: Photography and film
1. When taking out a membership with GymBokx, you agree to be filmed and photographed within GymBokx or during its events. In addition, you agree that this photo and film material can be used on social media and/or for marketing purposes. If you do not wish to be filmed or photographed, you must indicate this yourself to the filming coach or third party. You will then be kept out of the picture or made unrecognizable.

Article 20: Other provisions
1. All cases and/or situations not provided for in the above general terms and conditions will be assessed exclusively by the management and the owner of GymBokx. All disputes that arise between GymBokx and members will be settled by a disputes committee and/or competent court to be determined.
2. Dutch law applies to membership.

Article 21: Amendment clause
1. We are entitled to change or supplement the general terms and conditions. Minor changes of minor importance can always be implemented. We will announce major substantive changes.
